Do you need a tree removal permit in Raleigh, NC?

Protected trees

On sites 2 acres and larger without a recorded tree conservation area, no tree disturbing activity (except minor tree removal) is allowed in a 32-foot perimeter buffer next to vacant property, a 65-foot buffer next to a non-thoroughfare road or non-vacant property, or a 50-foot buffer next to a thoroughfare. In those buffers no tree 10 inches DBH or larger may be removed, except up to 5 trees between 10 and 22 inches DBH in a continuous 5-year period with a city permit. Champion trees and their critical root zones may not be disturbed. Trees in recorded tree conservation areas need a tree conservation permit.

Street trees

Street trees in the right-of-way and trees on city-owned or controlled land are city trees. The city says a Tree Impact Permit is required for all city trees impacted. Its page also defines the critical root zone as a circle with a radius of 1.25 feet per inch of trunk diameter. The right-of-way is not a fixed distance from the curb; city inspectors can help decide where it is.

Dead or hazardous trees

In tree conservation areas, an unsafe or unhealthy tree can be removed with a tree conservation permit after a certified arborist, registered forester or licensed landscape architect certifies it in writing. No certification is needed if the tree died of natural causes and is replaced under the code's replacement standards.

How to apply

Tree Impact Permit: if the work is not part of a plan under city review, apply on the city's Permit and Development Portal (permitportal.raleighnc.gov) and search for "Tree Impact Permit". If it is part of a plan under review, the permit is issued through that review. The city lists 919-996-4115 for reporting tree issues.

Penalties

For sites 2 acres and larger without a recorded tree conservation area, the code lists penalties for unlawful disturbance in the perimeter buffer: $1,000 for the first tree, plus $100 per diameter inch for each other tree or stump 3 inches or larger (or 35 cents per square foot of disturbed buffer if no trees or stumps remain), capped at one-third of the site's land tax value, plus replanting. Other penalties not confirmed.

HOA note

HOA rules can be stricter; check yours.

A city permit does not override your HOA. Check your covenants before work starts.

For homeowners

Before a tree comes down in Raleigh

  • Check the city rule above and call the city if anything is unclear.
  • Ask the tree company who gets the permit and put it in the written quote.
  • Get two or three written quotes from local insured pros.
  • Never cut near power lines. Call the utility for downed lines and 911 if anyone is in danger.
