Tree work license

State license required

Maine law (7 M.R.S. section 2179) says a person may not advertise, consult, solicit, contract or engage for pay in the business of an arborist without an arborist license. Section 2173 defines an arborist as someone who, for pay, takes down or fells, diagnoses or evaluates, or treats or cares for shade or ornamental trees; care includes pruning or trimming that requires leaving the ground, and cabling or bracing. Section 2174 lists exemptions, such as work on your own property and workers on a site where a licensed arborist is present. Applicants must be 18 or older, pass an exam and show proof of financial responsibility (section 2181).

Pesticide and plant health care

Maine law (22 M.R.S. section 1471-D) says no commercial applicator may use or supervise the use of any pesticide without prior certification by the Board of Pesticides Control, and no spray contracting firm may use any pesticide without prior certification. This covers all pesticides, not only restricted-use ones, though the board may ease rules for some low-risk hand applications. Arborist and pesticide licenses are separate.

Contractor license

We did not find a Maine state contractor license that covers tree work. Separately, Maine law says any home construction contract for more than $3,000 in materials or labor must be in writing; check whether your type of job counts. A written estimate or contract is a good habit either way.

Local permits and tree rules

Towns and cities may have their own tree ordinances, shoreland zoning rules or right-of-way permits, so check with the town office before cutting near water or the road.

Check with the city or county where each job is. Homeowners often ask about this too; you can send them our plain guide to tree permits.

Insurance basics

Maine's arborist license requires proof of financial responsibility in amounts set by department rules; talk to a licensed insurance agent about liability and workers' compensation coverage that fits your company.

General information, not insurance advice. Talk with a licensed agent who knows tree work. More in insurance for tree services, or rough your cost with the workers comp estimator.
